Terms of Service

Established September 11, 2026

These Terms of Service ("Terms") set out the conditions for using the diary app "Daymoir" ("the Service"), provided by Hiroaki Nagahashi ("the Operator"). By using the Service, you ("the User") agree to these Terms.

Article 1 (Application)

These Terms apply to all dealings between the Operator and Users regarding use of the Service. Any individual notices the Operator provides within the Service, and the Privacy Policy, also form part of these Terms.

Article 2 (Accounts)

  1. Users create an account for the Service using Sign in with Apple.
  2. Users are responsible for managing their own Apple Account and devices. The Operator is not liable for damages arising from use by a third party, except where the Operator acted with intent or gross negligence.
  3. Users under the age of 18 must obtain a parent or guardian's consent before using the Service.

Article 3 (Handling of Diary Data)

  1. Rights to the text and photos a User inputs into the Service, and to the diary entries, recaps, and similar content the Service generates from them ("Diary Data"), belong to the User.
  2. The Operator handles Diary Data only to the extent necessary to provide the Service (AI-based formatting, summarization, and search of diary entries; display; storage; and backup).
  3. The Operator does not use Diary Data to train AI models, and does not use or sell it for advertising purposes.

Article 4 (AI-Generated Content)

  1. The Service uses AI to generate diary text, titles, recaps, and answers to questions, among other content. AI-generated content is not guaranteed to be accurate or complete.
  2. AI-generated content is not medical, legal, financial, or other professional advice. If you are experiencing mental or physical distress, or a serious personal concern, please consult an appropriate specialist service or medical institution.

Article 5 (Shared Journals)

  1. Content and display names posted to a shared journal can be read by every member of that journal.
  2. Please give invite codes only to people you want to join. The Operator is not liable for damages arising from inadequate management of an invite code, except where the Operator acted with intent or gross negligence.
  3. The creator (owner) of a shared journal may remove members or delete the shared journal.

Article 6 (Paid Plan)

  1. Some features of the Service are offered through a paid plan (¥480/month or ¥4,800/year, tax included). Features available under the paid plan are shown within the app.
  2. The paid plan is provided as an App Store auto-renewing subscription, and payment is charged to the User's Apple Account.
  3. The paid plan renews automatically for the same term unless canceled at least 24 hours before the end of the current term. Cancellation is done from "Subscriptions" under your Apple Account in the iPhone Settings app.
  4. Refunds of amounts already paid follow Apple's policies. Except where required by law, the Operator does not issue refunds.
  5. The Operator may change the price or content of the paid plan. Any price change will be announced in advance, including within the app.

Article 7 (Prohibited Conduct)

Users must not do any of the following:

  1. Acts that violate laws or public order and morals, or that are related to criminal activity
  2. Acts that infringe another person's copyright, right of publicity, privacy, or other rights
  3. Acts of harassment, discrimination, or intimidation toward others, including other members of a shared journal
  4. Impersonating another person, or using another person's account
  5. Placing excessive load on the Service's servers or network, or accessing them without authorization
  6. Decompiling or reverse-engineering the Service
  7. Accessing the Service in bulk by automated means
  8. Any other act the Operator deems inappropriate

Article 8 (Changes to and Suspension of the Service)

The Operator may suspend all or part of the Service without prior notice for maintenance, failures, natural disasters, or other unavoidable reasons. The Operator may also change the content of the Service or discontinue it. When discontinuing the Service, the Operator will give notice a reasonable time in advance.

Article 9 (Suspension of Use / Withdrawal)

  1. If a User violates these Terms, the Operator may suspend that User's access or delete their account without prior notice.
  2. Users may withdraw at any time from "Delete Account" in the app's settings. Withdrawing deletes all Diary Data (see the Privacy Policy for how inquiry records are handled). If you are unable to do this yourself, please contact support@daymoir.app.
  3. If you have a paid plan, withdrawing from the Service does not automatically cancel your App Store subscription. Please cancel it separately using the method in Article 6.

Article 10 (Disclaimer)

  1. The Operator strives to prevent loss of Diary Data, but does not guarantee that Diary Data will never be lost due to a failure or other event.
  2. The Operator is not liable for damages a User incurs in connection with use of the Service, except where the Operator acted with intent or gross negligence.
  3. Even where the Operator is liable (including cases where Japan's Consumer Contract Act applies), unless the Operator acted with intent or gross negligence, the amount of damages is capped at the total fees the User paid for the Service in the 12 months preceding the month in which the damage occurred.

Article 11 (Changes to These Terms)

The Operator may change these Terms under Article 548-4 of the Civil Code of Japan. When changing them, the Operator will announce the revised content and effective date, within the Service or on this page, before the change takes effect.

Article 12 (Governing Law and Jurisdiction)

These Terms are governed by and interpreted under the laws of Japan. Any dispute relating to the Service shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the Operator's address as the court of first instance.
